TERMS AND CONDITIONS OF ROCK STUDENT STORAGE, LLC

 

The following paragraphs contain the general terms and conditions under which Rock Student Storage, LLC (“RSS”) is engaged in the movement, transportation, rental, and/or storage of personal items including, but not limited to, boxes and packages within the State of Michigan.  RSS reserves the right to amend any portion of this service explanation at any time.  The most current service explanation may be found at RSS Web site (www.rockstudentstorage.com) and is available upon written request from RSS’s main office at 506 S. Charles, Lansing, MI 48912.

 

1.        SERVICE.  Storage Services shall include the pickup, transportation, storage, and delivery of the Customer’s possessions.  The Customer shall present pre-packed personal goods to RSS at the time of pickup.  RSS shall transport these goods to the storage facility owned and operated by RSS.  RSS will return the goods to the Customer during dates and times established by RSS by considering school and dormitory schedules.  Customer agrees to be present to receive the goods at the specified delivery date, time, and location.

 

2.       STORAGE.  The Customer understands that access to boxes in storage shall be permitted and shall require 5-days prior notice and payment of a non-refundable fee pursuant to the Pricing section below.  If the items must be delivered prior to the specified delivery dates, an additional fee will apply pursuant to the Pricing section below.  Early delivery shall not include items such as futons, couches, dressers and the like.   Customer understands that access to such large items such as futons, couches, dressers, etc. shall not be permitted at any time during the storage period(s).

 

3.       THE MATERIAL DROP-OFF.  The Customer will be provided dates and times for the materials that they will need for their packing.  The customer shall have established an account with RSS and provide a school ID.  The customer at that time shall sign a contract with RSS.  On this contract, the customer will acknowledge that he or she has read the Terms and Conditions. The terms and conditions are the same as on the website.

 

The Customer will receive the materials that he or she requested, and at this time they may request additional materials.   A Customer Service representative will indicate the amount of materials given.  The boxes that the customer takes must be paid for at time of delivery.  Any extra boxes that the customer does not use should be given back on the day of their scheduled pick-up.  If the customer takes more boxes than they use and does not return them in same condition that they received them, there will be additional charges for those items.

 

The cost for items are as follows: small box: $3.00, medium box: $4.00, large box: $5.00

 

4.       PICK-UP AND DELIVERY.  RSS will provide the Customer with a date, time and location of which pickup or delivery will occur.  This information will be provided by telephone to the customer.  RSS provides storage services subject to a number of restrictions, including but not limited to, absolutely no flammable liquids, toxic materials, firearms, illegal substances and/or drug paraphernalia.  The Customer accepts full responsibility and liability for any damages or losses that result from the Customer’s failure to adhere to these service restrictions.  The Customer must communicate any changes to the previously scheduled delivery date or location to RSS at least 15 days prior to the earlier of the originally scheduled delivery date and the new delivery date.  Changes made within 14 days of delivery are not guaranteed.  An additional fee may be assessed pursuant to the Pricing section below.

 

  The Customer recognizes that RSS will not be held liable for damage to their belongings after delivery has occurred.  In the event that the Customer is not present during their scheduled delivery date and time, RSS representatives will not leave items behind and the customer will have to make arrangements for a re-delivery solely at the expense of the Customer.  Customers must notify RSS in advance if someone else is to receive their belongings.

 

The Customer recognizes that only loss or damage caused by the negligence of RSS will be covered by RSS insurance policy, as described in these Terms and Conditions.  Only physical damage to the exterior of the item will activate any insurance claim on the item.

 


5.       HOW TO PACK GUIDE.  The Customer acknowledges reading and accepting the terms of RSS Packing Tips as found on RSS Web site and agrees that the safe packing of items is the sole responsibility of the Customer.

 

6.       PRICING AND DEPOSITS.  The Customer agrees to pay the total cost of the services provided by RSS based on the number and type of items tendered to RSS at the time of pickup, the exact services to be provided, and the prices contained on RSS web site.  The Customer further agrees to pay any applicable fees as specified in the Pricing Section.  The Customer agrees to pay a $25 deposit to reserve space for our services.  The deposit will be credited against the Customer’s final bill.  Deposits will be refundable only if requested prior to 2 weeks before the Customer’s finals week and/or the designated pick-up date.  The deposit will be refunded in full in the event that RSS is unable to perform the services for the Customer for any reason other than the Customer’s willful acts to void the contract.

 

  All charges for services are due and payable immediately following the pickup of the Customer’s possessions.  All accounts shall be paid in full in cash, check or credit card at the time of pickup.  Any fees paid by credit card shall be assessed a 3.5% administrative fee. If the Customer has provided a credit card or bank account number to RSS, the Customer hereby authorizes RSS to charge the Customer-provided credit card or bank account for the balance owing for the services rendered and any additional fees after deducting the initial deposit.   The Customer acknowledges that they remain indebted to RSS for any balance owed on their account as a result of invalid credit card information or a dishonored check, RSS’s inability to receive credit card authorizations, or for any other reason, which prevents RSS from being paid for the services and any additional fees.  RSS reserves the right to hold the Customer’s possessions until payment has been received in full.

 

  The Customer acknowledges that their failure to pay their account in full prior to the delivery date could result in a change in the delivery date and the assessment of additional fees.  Pricing for the services shall be in accordance with the pricing schedule contained on RSS Website.  In addition, RSS will charge and the Customer will pay additional fees as described in this section.  The purpose of the additional fees is to compensate RSS for expenses it incurs beyond those associated with the provision of services according to standard procedures.  Additional Fees may be charged for the following, as explained in the sections of this Agreement:

Re-delivery After Failed Attempt - $150

 Summer Access  - $50

 Pick-Up or Delivery Outside Standard Dates - $200

 Late Change of Delivery Day or location - $100

 Billing Fee - $15

 Additional Abandonment Fees - Costs incurred when storage items are not c1aimed by the Customer.

 

7.       VENDERS/AGENTS.  RSS uses their own employees, equipment and trucks in performing the services for the Customer.  The Customer acknowledges the use of these employees and the fact that the Customer has no contractual relationship with these employees.

 

8.       INSURANCE/LIABILITY.   The following shall govern RSS’s liability under this Agreement:

 

(a)    RSS, when transporting to or from the warehouse for storage contemplated under this Agreement acts as a private carrier only, reserving the right to refuse any order for transporting and in no event is a common carrier.

 

(b)   This contract is accepted subject to delays or damages caused by war, insurrection, labor troubles, strikes, Acts of God or the public enemy, riots, the elements, street traffic, elevator service or other causes beyond the control of RSS.

 


(c)    RSS is not responsible for any fragile articles injured or broken, unless packed by its employees and unpacked by them at the time of delivery.  RSS will not be responsible for mechanical or electrical functioning of any article such as but not limited to, pianos, radios, CD players, computers, television sets, clocks, barometers, mechanical refrigerators or air conditioners or other instruments or appliances whether or not such articles are packed or unpacked by RSS.

 

(d)   No liability of any kind shall attach to RSS for any damage caused to the goods by inherent mice, moths, vermin or other insects, rust, fire, water, changes of temperature, fumigation or deterioration.

 

(e)    Unless a greater valuation is stated on the front of this contract, the consumer-bailor or owner declares that the value in case of loss or damage arising out of storage, transportation, packing, unpacking, fumigation, cleaning or handling of the goods and the liability of RSS for any cause for which it may be liable for each or any piece or package and the contents thereof does not exceed and is limited to $0.30 per lb. per article, or for the entire contents of the entire storage lot does not exceed and is limited to $2,000, upon which declared or agreed value the rates are based, the consumer-bailor or owner having been given the opportunity to declare a higher valuation without limitation in case of loss or damage from any cause which would make RSS liable and to pay the higher rate based thereon.  RSS’s liability may, upon written request of the consumer-bailor at the time of the signing of this contract or within a reasonable time thereafter be increased on part or all of the goods stored.  The rates charged for such increased valuation are set forth on the front side of this contract.  The consumer-bailor acknowledges that he or she has been furnished with a pre-addressed request form to enable the consumer-bailor to request such increased valuation after the date of signing of this contract.  This pre-addressed request form must be received by RSS within ten (10) days after the consumer-bailor’s household goods have been deposited with RSS for storage in order to increase the liability of RSS for loss or damage to the consumer-bailor’s goods.

 

(f)    In no event shall RSS be responsible for loss or damage to documents, stamps, securities, specie or jewelry or other articles of high and unusual value unless a special agreement in writing is made between the consumer-bailor and RSS with respect to such articles.  RSS strongly recommends the purchase of additional insurance.  Insurance can be purchased one and/or two ways:

 

 

i)        Through RSS, (the day that we pick-up your items).  It can be purchased at the replacement rate of $10 per $500, (you will say which box, or item that you would like to insure).  This insurance is in effect from the time of pick-up until you return in the fall.

ii)       OR through The CSI Protection Group.  This company provides personal property insurance plans for college students nationwide.  The one-year policy covers the replacement cost for students’ property for less than the cost of a homeowner’s deductible.  You can visit CSI protection group at www.collegestudentinsurance.com or call: (888) 411-4911.

 

9.       ABANDONMENT.  Without limiting the right of RSS to conclude for other reasons that the Customer will not be returning to school, the Customer agrees that their failure to be present on the scheduled delivery day and their failure to communicate with RSS concerning an alternate delivery arrangement constitutes abandonment of their stored possessions. Under abandonment of their possessions, the Customer agrees to pay RSS for all charges and fees relating to the failed delivery and further shipping of the possessions to the permanent address provided by the Customer at the time of registration.  RSS has the right to assume ownership of the abandoned property on December 30th of the service year.

 


10.      WAIVER.  Except as specifically provided in this Agreement, the Customer waives any claims for damage or loss of any article against RSS and its employees.  The Customer expressly releases and holds ROCK STUDENT STORAGE, LLC, and its agents and employees harmless from any and all costs of processing any claim or defending any claim arising from this Agreement.  The Customer expressly acknowledges that RSS is not a professional storer, mover or common carrier and waives the right to hold RSS to any laws or standards governing storers, movers or carriers.

 

11.      APPLICABLE LAW.  The Customer acknowledges that there are no representations, warranties, or agreements by or between the parties which are not fully set forth herein and no representative of RSS or RSS’s agents is authorized to make any representations, warranties, or agreements other than as expressly set forth herein.  A writing signed by the parties may only amend this Agreement.

 

12.      ENTIRE AGREEMENT.  This Agreement shall be governed, interpreted, and construed according to the law of the State of Michigan.  The Customer agrees that any court action pertaining to this agreement shall be conducted in courts in the State of Michigan.
